ACT NO. 13 OF 2025 AND NOT BILL 7
Attorney General for the republic of Zambia Mr. Mulilo Kabesha says once a bill is assented to by the president, it immediately ceases to be referred to as a bill and becomes an act of parliament, a law with full legal effect.
Mr. Kabesha says he has observed that despite this
clear constitutional process, some individuals, including highly educated
persons, have continued to refer to the constitution of Zambia (amendment) bill
no. 7 of 2025 as a “bill 7,” even though it ceased to be called a bill on 18th December
2025, when the president assented to it.
He says upon assent of the constitution of Zambia
(amendment) bill no. 7 of 2025 on 18th December 2025, the bill ceased to exist
as a bill and became an act of parliament.
Mr. Kabesha says the former bill no. 7 is now
officially constitution of Zambia (amendment) act no. 13 of 2025, forming part
of the laws of Zambia with full legal effect.
He explains that a bill is merely a proposed law
presented to the national assembly for consideration and possible enactment and
once it has successfully undergone all legislative processes and is assented to
by the president, it becomes an act of parliament, a binding law with full
force and effect.
Mr. Kabesha says the constitution of Zambia
(amendment) act, 2025 now has legal effect, and its provisions are read
together with the constitution of Zambia, chapter 1 of the laws of Zambia.
He stated that the constitution, as amended under
act no. 13 of 2025 has legal effect and shall be read as one with the
constitution of Zambia, chapter 1 of the laws of Zambia.
Mr. kabesha says the ministry of justice has engaged
the electoral commission of Zambia and the ministry of local government and
rural development in order to begin the drafting process for the consequential
legislation, particularly the electoral process act and any relevant subsidiary
legislation, to give effect to the constitutional provisions as amended.
